1. About the Game

Find Differences: Spot the Difference is a casual picture puzzle game in which players compare similar images and identify visual differences.

The Game may include features such as:

• picture-comparison levels;
• timers;
• Hints;
• additional time;
• level unlocking;
• continuation opportunities;
• Daily Gifts;
• daily check-in rewards;
• Share Rewards;
• Revisit Rewards;
• Add-to-Home or shortcut-related rewards;
• rewarded advertisements;
• other virtual gameplay features.

Game features may change from time to time.

2. TikTok Platform

The Game is made available through the TikTok Mini Games platform.

Your use of TikTok itself remains subject to TikTok's own:

• Terms of Service;
• Privacy Policy;
• Community Guidelines;
• Mini Games rules;
• advertising rules;
• technical and platform requirements.

TikTok is an independent platform provider.

Nothing in these Terms changes or replaces your separate relationship with TikTok.

Certain Game functions depend on functionality provided by TikTok and may therefore be subject to TikTok's availability, policies, eligibility requirements, technical limitations, and regional restrictions.

3. Eligibility

The Game is not directed to children under 13 years of age.

You may use the Game only if:

• you are at least 13 years old;
• you are legally permitted to use TikTok and the Game in your jurisdiction;
• your use of the Game complies with applicable law;
• your use complies with TikTok's applicable terms and policies.

If you are under the legal age of majority where you live, you represent that you have any permission required under applicable law to use the Game.

You do not acquire any ownership interest in the Game, its software, content, Game assets, or intellectual property.

The Game may use technical identifiers, including TikTok OpenID, to associate gameplay information with your player record.

This may include:

• level progress;
• Game state;
• reward status;
• feature state;
• settings;
• gameplay history;
• other Game-related information.

We may use this information to restore your Game state or recognize a returning player.

However, we do not guarantee that progress will always be recoverable or preserved.

Progress may be affected by:

• technical failures;
• server errors;
• TikTok platform changes;
• device changes;
• TikTok account changes;
• clearing local storage;
• network failures;
• Game updates;
• changes to Game features;
• discontinued features;
• data corruption;
• other technical circumstances.

7. Gameplay Rules

The Game may require you to:

• compare two or more images;
• identify visual differences;
• tap or select differences;
• complete a level within a time limit;
• use available Hints;
• obtain additional time;
• unlock eligible levels;
• complete other gameplay objectives.

Specific instructions, time limits, reward conditions, or level requirements may be displayed directly within the Game.

Game rules may vary by level.

8. Virtual Items and Virtual Rewards

The Game may provide virtual items, virtual benefits, or other in-game rewards (“Virtual Rewards”).

Virtual Rewards may include:

• Hints;
• additional time;
• “+60s” rewards;
• level tickets;
• level access;
• continuation opportunities;
• Daily Gifts;
• daily check-in rewards;
• Share Rewards;
• Revisit Rewards;
• Add-to-Home rewards;
• shortcut-related rewards;
• other in-game benefits.

9. No Cash Value

Virtual Rewards:

• have no monetary value;
• are not legal currency;
• are not electronic money;
• are not stored-value products;
• cannot be exchanged for cash;
• cannot be redeemed for money;
• cannot be exchanged for real-world goods or services unless we expressly state otherwise;
• do not create any ownership or property right.

Unless expressly permitted in the Game, Virtual Rewards may not be:

• sold;
• traded;
• transferred;
• assigned;
• gifted;
• exchanged between users.

10. Rewarded Advertising

The Game may offer optional rewarded advertisements.

You may be given the option to watch an advertisement in exchange for a Virtual Reward or Game benefit.

Examples may include:

• receiving a Hint;
• receiving additional time;
• continuing after a failure or timeout;
• unlocking eligible content;
• unlocking a level;
• receiving another virtual benefit.

11. Reward Eligibility

A reward associated with a rewarded advertisement may only be granted after the applicable advertising or platform system confirms that required completion conditions have been satisfied.

A reward may not be granted if, for example:

• you close the advertisement before completion;
• the advertisement fails to load;
• the advertisement is interrupted;
• your network connection fails;
• the advertising platform does not confirm completion;
• the reward request is duplicated;
• fraud or abuse is detected;
• technical verification fails.

Where reasonably possible, we may attempt to correct confirmed reward-delivery errors, but we do not guarantee that every interrupted or failed advertisement will result in a reward.

12. Advertisement Availability

We do not guarantee that rewarded advertisements will always be available.

Availability may vary due to:

• your country or region;
• advertiser demand;
• advertising inventory;
• device type;
• operating system;
• TikTok version;
• network conditions;
• platform eligibility;
• technical availability;
• advertising policies;
• other circumstances outside our reasonable control.

If an advertisement is unavailable, the associated optional reward or feature may also be temporarily unavailable.

13. Advertising Content

Advertisements displayed within or in connection with the Game may be provided by TikTok, advertisers, advertising networks, or other third parties.

NESTLEAP ZUE LLC does not necessarily:

• create;
• select;
• endorse;
• guarantee

all products, services, claims, or content contained in third-party advertisements.

Your dealings with third-party advertisers are separate from your relationship with us.

14. Daily Gifts and Check-In Rewards

The Game may offer Daily Gifts, daily check-in rewards, or similar recurring rewards.

Eligibility may depend on requirements such as:

• opening the Game on an eligible day;
• completing a check-in;
• meeting a streak requirement;
• claiming the reward within a specified period;
• satisfying technical or platform requirements.

Daily reward programs may:

• reset;
• expire;
• change;
• be replaced;
• be temporarily suspended;
• be discontinued.

Unless expressly stated otherwise, unclaimed daily rewards do not accumulate indefinitely.

15. Share Rewards

The Game may provide optional rewards related to sharing Game content or Game links through TikTok.

A Share Reward may require:

• initiating an eligible sharing function;
• successfully completing the relevant platform flow;
• receiving confirmation from the platform;
• meeting daily or promotional limits.

We do not guarantee that sharing-related features will be available to every user.

Share functionality may depend on TikTok account, device, region, platform version, or other eligibility conditions.

16. Revisit Rewards

The Game may offer rewards for returning to the Game through eligible TikTok Mini Games entry points or other platform-supported revisit methods.

Revisit eligibility may depend on:

• how you entered the Game;
• whether TikTok confirms the relevant revisit action;
• applicable daily limits;
• device eligibility;
• region;
• platform availability;
• technical conditions.

We may adjust Revisit Reward rules from time to time.

17. Add-to-Home and Shortcut Rewards

The Game may offer optional rewards related to Add-to-Home, desktop shortcuts, Home Screen shortcuts, or similar TikTok-supported functionality.

A reward may require successful completion or confirmation of the relevant platform action.

Not all devices, operating systems, TikTok versions, or regions may support these features.

We do not guarantee that Add-to-Home or shortcut functionality will be available to every player.

18. Level Unlocking

Certain levels may require completion of a prior level, use of a Virtual Reward, completion of a rewarded advertisement, or another eligibility condition.

Level access requirements may change over time.

We may modify:

• unlock requirements;
• level order;
• level availability;
• reward requirements;
• ticket requirements;
• advertisement requirements.

19. Extra Time and Continuation

The Game may offer additional time, continuation opportunities, or similar benefits.

Examples include:

• +60 seconds;
• continue after timeout;
• restart;
• continue after failure.

Some of these features may require:

• a Virtual Reward;
• a rewarded advertisement;
• a limited-use entitlement;
• another in-game condition.

Availability may vary.

20. No Real-Money Purchases

The current version of the Game does not offer:

• real-money in-app purchases;
• paid subscriptions;
• direct purchases of Hints;
• direct purchases of tickets;
• paid level unlocks;
• paid virtual currency.

The Game is currently monetized through advertising.

As a result, there is currently no in-game purchase or subscription refund program.

If we add real-money purchasing functionality in the future, we may update these Terms and provide additional purchase-related terms.

21. Changes to Rewards and Game Economy

We may modify the Game's virtual reward structure.

This may include changing:

• reward quantities;
• Hint amounts;
• number of available Hints;
• time bonuses;
• ticket requirements;
• daily reward amounts;
• advertising reward values;
• unlock conditions;
• reward eligibility;
• reward frequency.

Virtual Rewards are provided as part of the Game experience and are not guaranteed to remain available in a particular form or amount.

22. Promotional Features

We may occasionally offer:

• limited-time rewards;
• promotional events;
• experiments;
• new feature tests;
• bonus rewards;
• regional promotions.

Promotional features may have additional eligibility rules or expiration periods.

Unless otherwise required by law, promotional features may be modified or discontinued at any time.

• manipulate rewarded advertisement completion;
• falsify reward eligibility;
• use bots;
• use scripts;
• use macros;
• use unauthorized automation;
• interfere with Game servers;
• interfere with TikTok systems;
• attempt unauthorized access;
• bypass technical restrictions;
• circumvent security measures;
• distribute malware;
• disrupt Game functionality;
• impersonate another person;
• engage in fraudulent activity;
• use the Game for illegal purposes;
• abuse sharing or promotional systems;
• attempt to obtain Virtual Rewards fraudulently.

24. Cheating, Abuse and Fraud

We may use technical systems and Game records to investigate suspected:

• cheating;
• reward abuse;
• advertising manipulation;
• automated gameplay;
• fraudulent activity;
• exploitation of software bugs;
• unauthorized access.

If we reasonably determine that abuse has occurred, we may, subject to applicable law:

• cancel improperly obtained rewards;
• reset affected progress;
• restrict access to certain features;
• temporarily suspend access;
• terminate access to the Game.

25. Software and Technical Restrictions

Except where applicable law expressly permits otherwise, you may not:

• copy the Game;
• reproduce the Game;
• modify Game software;
• distribute Game software;
• extract Game assets for unauthorized use;
• create unauthorized copies;
• decompile protected software;
• disassemble protected software;
• reverse engineer protected portions of the Game;

Nothing in this section restricts rights that applicable law does not allow us to restrict.

• logos;
• branding;

• user interface;
• visual design;
• artwork;
• illustrations;
• characters;
• images;
• animations;
• level content;
• level design;
• sound;
• music;
• text;
• graphics;
• Game assets;
• promotional materials;
• other protected content.

Except for the limited license expressly granted under these Terms, no intellectual property rights are transferred to you.

27. Screenshots, Gameplay Videos and Personal Use

Unless prohibited by applicable platform rules or law, you may generally create and share ordinary screenshots or gameplay videos of the Game for personal, non-commercial purposes.

However, you may not use Game content in a way that:

• falsely suggests official sponsorship;
• infringes our rights;
• misleads users;
• copies substantial Game assets into a competing product;
• commercially exploits Game content without authorization.

We may publish separate content or creator guidelines in the future.

28. Feedback

If you voluntarily send us:

• ideas;
• suggestions;
• bug reports;
• comments;
• gameplay feedback;
• feature suggestions

you agree that we may use that feedback to improve, develop, market, or operate the Game without obligation to compensate you, to the extent permitted by applicable law.

• change Hints;
• change reward systems;

• suspension is required by law;
• suspension is required by TikTok or another platform provider.

35. Effect of Termination

If your access to the Game is terminated:

• Game progress may become unavailable;
• Virtual Rewards may become unavailable;
• Virtual Rewards cannot be redeemed for cash;
• certain stored information may be retained where necessary for legal, fraud-prevention, security, or recordkeeping purposes.

36. Discontinuation of the Game

We may discontinue the Game or part of the Game.

If the Game is discontinued:

• levels may become unavailable;
• Game progress may no longer be accessible;
• Game features may stop functioning;
• Virtual Rewards may become unusable.

Because Virtual Rewards have no cash value, unused Virtual Rewards are not redeemable for cash unless applicable law expressly requires otherwise.

38. Disclaimer of Warranties

“AS IS” and “AS AVAILABLE.”

• the Game will operate without interruption;
• the Game will be error-free;
• every bug will be corrected;
• all Game progress will always be preserved;
• advertisements will always be available;
• rewards will always be available;
• every device will support every feature;
• the Game will meet every user's expectations.

Some jurisdictions do not permit certain exclusions of warranties, so some of these exclusions may not apply to you.

39. Limitation of Liability

To the maximum extent permitted by applicable law, NESTLEAP ZUE LLC and its affiliates, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to the Game.

This may include damages relating to:

• loss of Game progress;
• unavailable rewards;
• interrupted gameplay;
• lost data;
• advertising failures;
• network problems;
• service outages;
• device incompatibility;
• third-party advertisements;
• third-party services.

To the maximum extent permitted by applicable law, our aggregate liability arising out of or relating to the Game will not exceed the greater of:

(a) US$100; or

(b) the total amount you directly paid to NESTLEAP ZUE LLC in connection with the Game during the twelve (12) months preceding the event giving rise to the claim.

Because the current version of the Game does not offer real-money purchases, paragraph (b) will ordinarily be zero.

Some jurisdictions do not permit certain limitations of liability, so these limitations apply only to the extent permitted by applicable law.

40. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless NESTLEAP ZUE LLC and its affiliates, officers, employees, contractors, and agents from claims, damages, liabilities, and reasonable costs arising from:

• your unlawful use of the Game;
• your material violation of these Terms;
• fraud or abuse committed by you;
• your infringement of third-party rights.

This section does not apply to the extent prohibited by applicable consumer protection law.

41. Consumer Rights

Nothing in these Terms limits rights that cannot lawfully be waived or excluded.
